Question: Is it advisable to conduct a search of the Office records before filing an application?

Answer:
Yes. You may conduct a search free of charge on the USPTO website using the Trademark Electronic Search System (TESS).


Question: Can the Office refuse to register a mark?

Answer:
Yes. The Office will refuse to register matter if it does not function as a trademark. Not all words, names, symbols or devices function as trademarks.

Question: Do I have to be a U.S. Citizen to obtain a federal registration?

Answer:
No. However, an applicant's citizenship must be set forth in the record. If an applicant is not a citizen of any country, then a statement to that effect is sufficient.
